He found himself up against experienced construction defect defense attorneys from the following law firms: Bronson, Bronson & McKinnon, Severson, Werson, Burke & Melchoir, Heller, Ehrman, White & McAuliff, Hassard, Bonnington, Rogers & Huber, & Hauerken and St. Clair. Mr. Browne proceeded to put together a team of design professionals and legal support sufficient to prepare for and handle the situation at hand. Nevertheless the defense lawyers and their insurance claims representatives refused to make a reasonable settlement offer. Trial began in Judge Jay Pfotenhaur's courtroom against a $25,000 settlement offer. Mr. Browne conducted the trial for a week against a team of defense lawyers from the law firms listed above, examining witnesses and introducing documentary evidence. On Sunday night preceding the second week of trial, the defense put together an offer of $365,000, which was acceptable to the HOA directors as being reasonable and sufficient to make the necessary repairs and cover the litigation expenses. The settlement was placed on the record on Monday morning, and Mr. Browne had successfully earned a reputation of respect for his abilities that continues and grows to this day. |
