Mr. Browne's 30 plus years in handling this type of litigation began in the mid-1970's, when he was retained by an HOA of about 160 homeowners on Nob Hill in San Francisco. Mr. Browne learned at that time the importance of selecting competent, experienced and trustworthy design professional consultants and to bring in other specialized attorney and paralegal support as needed in order to assist him in handling construction defect cases successfully and cost effectively. While each of these cases are unique and no two are the same, generally speaking it is necessary to (1) ascertain the nature and extent of a given defect at a condominium or other construction project; (2) determine whether the defect is a design or building defect and determine after reviewing records which entity or entities may be responsible for the defects; (3) determine the nature and extent of necessary remedial repairs or retrofits; (4) ascertain the cost of the latter; and (5) proceed to negotiate a settlement that is advantageous to the HOA or other property owner, or vigorously litigate the claim as necessary. |
